Order On order of the Court, the motion to file brief amicus curiae is considered, and it is GRANTED. The application for leave to appeal also is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Recorder's Court for proceedings consistent with People v Hill and Veling, 443 Mich. 23 (1993). In all other respects, leave to appeal and leave to appeal as cross-appellant are DENIED. The application for leave to appeal and the application for leave to appeal as cross-appellant in People v Rode No. 102523 remain under consideration by the Court
